Terms of use
Effective · Version 1.1
The short version
- Your content is yours. We only use it to run Pebbles for your household.
- You must be at least 16, and you’re responsible for who you invite into your household.
- Reminders help, but don’t rely on Pebbles alone for anything critical, like medication or medical appointments.
- Pebbles is free today. If you ever pay for Pro, prices and renewal terms are shown before you buy, and you can cancel any time.
- Your rights under consumer protection laws, including Quebec’s, always apply.
This summary helps you find your way. The full text below is what applies.
These terms are an agreement between you and WebArtefacts Inc., 2246 Bayview Drive SW, Airdrie, Alberta T4N 5B6, Canada (“Pebbles”, “we”, “us”), for using the Pebbles app on iPhone and the web and this website (together, “Pebbles”). By creating an account or using Pebbles, you accept these terms and our privacy policy.
These terms are also available in French. Ces conditions sont aussi offertes en français. By using the English version, you choose to be bound by it.
Who can use Pebbles
You must be at least 16 years old and able to enter into a contract where you live. If you use Pebbles for someone else, such as a family business, you confirm you’re allowed to accept these terms for them.
Your account
- Give accurate information and keep your email address up to date; it’s how we reach you about your account.
- Keep your password to yourself. You’re responsible for what happens in your account, so tell us right away at dereck.guay@webartefacts.com if you think someone else has used it.
- Each account belongs to one person and one household.
You can delete your account at any time in Settings, under Account. The privacy policy explains what is erased and when.
Households
A household is the shared space where members see and edit the same lists, tasks and calendars. The person who creates it is its owner.
- Invite only people you trust. Anyone with your household’s invite code can join it and will see everything shared there. You can change the code in Settings, which stops the old one from working.
- Members can add, change, complete and delete shared items. Pebbles keeps an activity history so everyone can see who did what.
- Items marked private stay visible only to the person who made them.
- When a member leaves or deletes their account, what they shared stays with the household.
Your content
Everything you and your household add to Pebbles (“your content”) stays yours. You give us a limited, worldwide, non-exclusive, royalty-free permission to store, copy, sync, display and transmit your content only as needed to run Pebbles for you and your household, including sending it to calendar services you connect. This permission ends when your content is deleted from Pebbles, except for copies in backups, which roll off as the privacy policy describes.
You’re responsible for your content. Make sure you have the right to share it, especially when it’s about other people, such as your children or people outside your household.
Using Pebbles responsibly
Don’t:
- break the law, or use Pebbles to harass, threaten or harm anyone;
- add content you don’t have the right to share, or that is illegal, hateful or sexually exploits anyone, including minors;
- try to reach other households’ data, probe or break our security, or disrupt Pebbles (for example with excessive automated requests);
- copy, reverse engineer or resell Pebbles, except where the law expressly allows it;
- use Pebbles to send spam, including invitations to people who don’t expect them.
Connected calendars and other services
When you connect iCloud, Google or another service, Pebbles exchanges data with it on your behalf, and your use of that service is governed by its own terms and privacy policy. Pebbles copies your household’s shared calendars into the connected account and keeps them in sync both ways. We aren’t responsible for outside services, their availability, or changes they make to what they allow.
Reminders, sync and availability
We work hard to make Pebbles reliable, including offline. Still:
- Reminders and notifications can be late or missed, for example if notifications are turned off, the phone is off or low on power, or iOS limits them. Don’t rely on Pebbles alone for anything critical to health or safety, such as medication, medical appointments or childcare pickups.
- Changes made offline sync when you’re back online. When two people change the same thing, Pebbles shows what happened, but in rare cases a change can be overwritten.
- Pebbles is currently in beta. Features may change, and we may pause Pebbles for maintenance.
Plans and payments
Pebbles is free today. We plan to offer a paid Pro plan. If you subscribe:
- The price, billing period and what’s included are shown before you pay. Prices are per household unless stated otherwise, and taxes are added where required.
- Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time, and you keep Pro until the end of the period you paid for.
- If you subscribe on iPhone, the purchase is made through your Apple ID and handled by Apple under its terms: you manage and cancel it in your Apple ID settings, and refund requests go to Apple.
- We will tell you at least 30 days before a price change takes effect, and you can cancel before then.
- Nothing in these terms limits a right to cancel or a refund you have under the law, including Quebec’s Consumer Protection Act.
If Pro ends or you stop paying, your content stays. You keep the free features.
Our rights in Pebbles
Pebbles, its design, logo and software belong to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app and website as these terms allow. If you send us ideas or feedback, we may use them without owing you anything.
Suspension and ending
You can stop using Pebbles and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, puts others at risk, or where the law requires it. Unless it would be unsafe or unlawful, we will tell you first and give you a chance to export your content. If we ever stop offering Pebbles, we will give you at least 60 days’ notice to export your content.
Warranties and liability
We provide Pebbles with reasonable care and skill. Other than that, and to the extent the law allows, Pebbles is provided “as is”, without other warranties, including that it will be uninterrupted or error-free.
To the extent the law allows, we aren’t liable for indirect or consequential losses, or for losses caused by outside services, by your devices, or by relying on reminders for critical matters. Where our liability can be limited, it is limited to the greater of what you paid us in the 12 months before the claim and CA$100.
None of this excludes or limits liability that the law does not allow us to exclude or limit. In particular, if you are a consumer in Quebec, the legal warranties and protections of the Civil Code of Québec and the Consumer Protection Act apply in full, and the clauses above apply only as far as those laws allow. The same is true of consumer protection laws where you live.
If you downloaded Pebbles from the App Store
These terms are between you and us, not Apple. Apple isn’t responsible for Pebbles or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. We, not Apple, are responsible for handling any claim about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy, and claims that the app infringes someone’s intellectual property. You confirm you are not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
Changes to these terms
We may update these terms, for example when we add features or when the law changes. We will post the new version here with a new effective date and, for important changes, tell you in the app or by email at least 30 days before they apply. If you don’t agree, you can delete your account before then. Continuing to use Pebbles after that means you accept the new terms.
Law and disputes
These terms are governed by the laws of the province of Alberta and the federal laws of Canada that apply there. Disputes go to the courts of Alberta sitting in Calgary, unless the law of your place of residence gives you the right to bring them where you live, as it does for consumers in Quebec and in many other places. Before going to court, please write to us: most problems can be solved quickly.
If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still enforce it later.
